The use of the ALS Industrial Pty Ltd (‘ALS’, ‘we’, ‘our’, ‘us’) Asset Health Manager site (‘Site’) implies acceptance of these terms and conditions of use (‘Terms’). Please review the Terms and if you do not accept them, discontinue use of the Site.
We reserve the right to amend the Terms at any time without notice. Any amendment will be effective immediately. You will be deemed to have accepted any amendment to the Terms on the first occasion you use this Site after publication of the amended Terms.
Access to this Site is to be by authorisation of ALS only. If you have gained access to this Site in error, exit immediately. Use of this Site is logged. Unauthorized access may lead to prosecution.
We have taken precautions to secure the Site against unauthorized access; however, you must recognize that there are inherent security risks in using the Internet to transmit data. Initial and continued use of the Site indicates acknowledgement and acceptance of these risks.
IP Ownership and Permitted Use
All intellectual property rights in the content of this Site and the Asset Health Manager system (including copyright in all source and object codes of the software and the design and layout of the software and any registered or unregistered trade marks) are owned by us or third parties from whom we have acquired the right to use such intellectual property.
You are permitted to view, download, print and copy content from the Site subject to the following restrictions and in accordance with any written agreement between you and ALS:
(a) the content may be used solely for non-commercial, personal or internal business use;
(b) if you make a copy of any part of the Site, you must ensure that each copy properly attributes the source, including all intellectual property rights notices originally shown or included in the content; and
(c) you may not use, adapt, reproduce, store, distribute, create derivative works, publish or publicly display any content or software made available on the Site for any commercial or public purpose without our express prior written consent.
You must obtain our prior written consent if you intend to use, copy or reproduce any part of this Site or the Asset Health Manager system for any other purpose.
Nothing in the Terms shall be construed as granting you any right, title or interest in or to the intellectual property of ALS, any third party or any other user of this Site.
Security and Access
Control and security of user IDs and passwords is the responsibility of the client. You are responsible for keeping these details confidential and you must ensure that you exit from your account at the end of each session.Sharing of user IDs and passwords between client users is discouraged.
You or your client representatives must notify us immediately of any unauthorised use of your account or password and any other breach of security. We are not responsible or liable for any loss or damage that may occur as a result of someone else using your account or password, either with or without your knowledge.
You agree to:
(a) use your account to access only data for which you have authorisation from the owners of that data to view;
(b) not interfere or attempt to interfere with the proper operation of the Site or the Asset Health Manager system (including by knowingly introducing viruses or other malicious or technologically harmful material) or take any action which causes, or may cause, interruption or degradation in our service to other users; and
(c) immediately cease using your account in the event your access rights are diminished, including, but not limited to, termination of employment or a change in your job responsibilities.
Client representatives must ensure that we are duly notified in the event that account access levels need to be disabled or modified.We will not be responsible for the inadvertent release of data to unauthorized users if notification has not been received in writing.
We will use reasonable endeavours to ensure that this Site is secure and to prevent unauthorised access to the Site.Security of this Site and the Asset Health Manager system is protected through the use of firewalls, virus scanning, and other security measures.You acknowledge, however, that there are risks inherent in any transmission or viewing of data across the Internet. Use of this Site and the Asset Health Manager system implies acceptance of these risks.
We reserve the right to terminate access to this Site and the Asset Health Manager system without notice if in our reasonable opinion you have failed to comply with any of this provisions of these Terms or in cases of suspected hacking or other abuse of the system.
We do not warrant the accuracy, completeness, reliability or timeliness of the content or any services provided through the Site. Your use of this Site, and reliance on its content, is entirely at your own risk.Except to the extent liability cannot be limited or excluded by law, ALS shall not be liable to you for any loss, damage or claim whatsoever which arises under or in connection with this Site, the Asset Health Manager system or any content (including because of our negligence), including, without limitation, consequential loss, loss of profits or revenue, economic loss, foregone business opportunities, business interruption, lost data or loss resulting from computer viruses or security failure.
We strive for 99.9% uptime on the Asset Health Manager Site. Unscheduled service interruptions will, however, occur from time to time.We do not accept any liability for delays in delivering results due to system outages, Internet connectivity problems or for other reasons.

The Terms and your use of this Site are governed by the laws of Queensland, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
Any provision of these Terms which is or becomes illegal, invalid or unenforceable, may be severed to the extent only of such illegality, invalidity or unenforceability and will not invalidate the remaining provisions.
